The BIOSECURE Act reflects bipartisan consensus in Congress about the potential national security risks posed by foreign biotechnology companies, including concerns about privacy issues around sensitive biological data (i.e., genetic material, proteomic data, etc.). In the months ahead, geopolitical conflict will hit home for research institutions as implementation of the BIOSECURE Act begins. Full enforcement of this legislation, enacted in December 2025 as Section 851 of the fiscal year (FY) 2026 National Defense Authorization Act (NDAA), is set to take effect in roughly two years, but universities should take steps now to minimize the impact of the BIOSECURE Act on day-to-day research operations.
The final enacted version of BIOSECURE provides several avenues through which an entity can be designated as a “biotechnology companies of concern”, including through the Department of Defense’s annually updated Section 1260H list.
